(“Moose”, “we”, “our” or “us”), how we collect, use and disclose information about visitors of our website https://www.moosetoys.com/ (the “Website”) and apps, and any content, tools, features and functionality offered on or through our Website  are collectively referred to herein as the “Services.” We will let you know which entity will be the controller of your data when you purchase our products or services. Moose Toys Ltd is the data controller and is responsible for this website.

By using the Services, you acknowledge that you’ve read and understood this Privacy Policy. For purposes of this Privacy Policy, “you” and “your” means you as the user of the Services. Aggregated information could be derived from personal information, but will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature or our Service more generally. 

We do not collect any special categories of personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. Our Services may require you to enter certain information about yourself. If you fail or choose not to provide such information, including personal information, doing so may prevent you from using or accessing the Services.

Any information we receive from other sources will be treated in accordance with this Privacy Policy. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices.

 

IV. Usage Data; Cookies and Other Tracking Technologies 

As you interact with the Services, we will automatically collect Usage Data by using cookies, web beacons/clear gifs, and other tracking technologies (“Tracking Technologies”). The Usage Information is used by Moose for aggregated statistical analyses or systems administration purposes only. No attempt will be made to identify users or their browsing activities, except where required by law.

Cookies When you interact with us on the internet, our system automatically sends you a ‘cookie’. A cookie is a small amount of information sent from a web server to your device that enables your device to be recognised. It is used to handle your internet sessions on that device and contains a unique identifier. Other information stored by the cookie includes Website traffic information. This information is not used to identify individual details. We only collate the information into anonymous results in order to evaluate and improve our internet user ability and services. 

Do Not Track Signals – The Services will respect your browser’s Do Not Track signals (or other well-established, commercially available mechanisms that provide you with the ability to exercise choice regarding the collection of personal information). If we receive a Do Not Track notice, we will stop using any personal data for online behavioral advertising purposes.

Most browsers accept cookies automatically, but you may disable/control cookies using your browser’s preferences, but some features of the Website may not function if you do so. If you so choose, you may block or delete our cookies from your browser; however, blocking or deleting cookies may cause some of the Services, including any portal features and general functionality, to work incorrectly. The Services also functions permitting creation of user-generated content, e.g. discussion forums, email lists, or similar social platforms, which users may elect to join and/or participate in. Through your participation, you may submit messages, information, reviews, ratings, text, illustrations, photographs, graphics, images, sounds, music, videos, files or any other materials (“User-Generated Content” or “UGC”). We or others may store, display, reproduce, publish, or otherwise use UGC, and may or may not attribute it to you. Others may also have access to UGC and may have the ability to share it with third parties. If you choose to submit UGC to any public area of the Services, your UGC will be considered “public” and will be accessible by anyone, including the Company.]

Please note that we do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure.  We are not responsible for the privacy or security of any information that you make publicly available on the features permitting creation of UGC or what others do with information you share with them on such platforms.  We are not responsible for the accuracy, use or misuse of any UGC that you disclose or receive from third parties through the forums or email lists.

We may provide links to websites or other online platforms operated by third parties or permit you to initiate interactions between the Services and third-party services or platforms, such as social networks (e.g., social media plug-ins). If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions.  We do not guarantee and are not responsible for the privacy or security of these sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms (such as Facebook or Twitter) may also be viewable by other users of the Services and/or users of those third-party online platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

From time to time we may use your personal information to identify particular Services which we believe may be of interest to you. You may at any time request that we, or third parties, stop sending you emails or other communications. California Civil Code Section 1798.83 permits customers of Moose who are California residents to request certain information regarding its disclosure of their personal information to third parties for their direct marketing purposes. If this applies, you may obtain the categories of personal information shared and the names and addresses of all third parties that received personal information for their direct marketing purposes during the immediately prior calendar year. For Canadian Residents

We may send you marketing communications by e-mail, text message or other electronic means unless you did not opt-in when required or have opted-out from receiving further messages. X. Entrants in Competitions, Contests and Sweepstakes

We may offer competitions, sweepstakes and contests through the Services that may require registration. By participating in a competition, contest or sweepstake, you agree to the terms, conditions and/or official rules that govern that particular promotion. If you choose to enter a competition, sweepstake or contest, we may disclose personal information to third parties or the public in connection with the administration of such competition, contest or sweepstake, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the official rules, such as on a winners’ list.

Some of our service providers may provide services to us entirely or partly from locations outside your jurisdiction and we may in order to receive those services occasionally transfer personal information to such other jurisdictions (where the information may be available to the government of these other jurisdictions), including where:

XII. UK and EU residents Only

European data privacy laws grant individuals subject to those laws the following rights with respect to their personal information:

  • To be informed – We must make this Privacy Policy (sometimes referred to as a privacy notice) available with the emphasis on transparency over how we process your information .

  • Access – You have a right to access your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

We may need to collect information from you to verify your identity, such as your email address, government issued ID or date of birth, before providing a substantive response to the request. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. 

 

XIV. Accessing and Checking the Personal Information We Hold About You

You have the right to request access to the personal information we hold about you. This right is subject to certain exceptions (see below) allowed by law. The file containing your personal information will be kept on our servers and those of our service providers

Moose will, upon your request to the Data Protection Manager (see Contact Us), and subject to applicable privacy laws, provide you with access to your personal information that is held by us. However, we ask that you identify, as clearly as possible, the type(s) of information requested. Moose will deal with your request in a reasonable time. Depending on the breadth of your request, we may recover from you our reasonable costs incurred in supplying you with access to this information.

We rely on the accuracy of the information you provide to us. If you think that we may hold information about you that is incorrect in any way, please contact us and we will correct any errors or inaccuracies where required.

Exceptions

Your right to access your personal information is not absolute. In some circumstances, the law permits us to refuse your request to provide you with access to your personal information. Such circumstances may include where:

  • Access would pose a serious threat to the life or health of any individual;

  • Access would have an unreasonable impact on the privacy of others;

  • The request is frivolous;

  • The information relates to a commercially-sensitive decision-making process;

Moose children’s privacy policy

We welcome children [under the age of [13]] (“Child” or “Children”) to access and use our Services. This Children’s Privacy Policy is intended to supplement (and not replace) our Privacy Policy, which applies to our general information collection practices for users of our Services. Capitalized Terms used but not defined in this Children’s Privacy Policy will have the meanings assigned to them in the Privacy Policy. 

Moose complies with the Children’s Online Privacy Protection Act of 1998 (“COPPA“) and the General Data Protection Regulation (“GDPR”). Please read this Children’s Privacy Policy carefully as it explains our information collection practices for Children using our Services, such as the type of information we collect regarding Children and how we may use that information. It also describes a parent’s or guardian’s (each, a “Parent”) ability to limit the collection and use of data collected from their Children and parental consent practices with respect to data provided by Children.

GDPRkids™ Privacy Assured

This assurance applies to the digital properties listed on the validation page that is viewable by clicking on the PRIVO GDPRkids™ Verified Shield. The PRIVO GDPRkids™ Privacy Assured Program supports child directed services known as Information Society Services under the General Data Protection Regulation (GDPR), to comply with the requirements of this legislation. It impacts any child directed service in an EU Member State and any service globally that collects and or processes the personal information of children and minors. There is no safe harbor for the GDPR to date, but to ensure our services meet the program requirements, PRIVO conducts regular monitoring and consulting.

 

II. What kind of information does Moose collect?

Below we summarize information collected and outline how and when we will provide parental notice and/or seek parental consent. In any instance that we collect personal information from a Child, we will retain that information only so long as reasonably necessary to fulfill the activity request or allow the Child to continue to participate in the Services, and ensure the security of our users and our Services, or as required by law. In the event we discover we have collected information from a Child in a manner inconsistent with applicable law, we will either delete the information or immediately seek the parent’s consent for that collection.

Information Provided by Children

Children may view most of the Website’s content without registering or providing personal information. Moose may collect a Child’s e-mail address under the following limited one-time use circumstances:

  • If a Child sends a request to us, we will keep their e-mail address to respond to them. We will then permanently delete their e-mail address from our system once we have responded to them;

  • If a Child enters a competition, sweepstake or contest, we will ask the Child to give us the Parent’s e-mail address, too, so that we can tell the Parent that the Child has registered for the competition, sweepstake or contest. We will only contact the Child once after the competition, sweepstake or contest is concluded to notify them if they have won or lost.  If we need more than the Child’s e-mail address and first name (or screen name), we will notify the Parent, explain what information we need and ask that the Parent provide it. For example, we will ask the Parent for his or her mailing address so that we can send, for the Child, any prizes the Child wins, or for his or her telephone number so that we can tell the Parent when the Child has won. All information collected from such competition, sweepstake or contest will be deleted from our database once the competition, sweepstake or contest is concluded, or after any legally required period for keeping such information has ended; or

  • If a Child signs up for our newsletters (e.g. in the Mighty Kingdom Shopkins apps). We collect the Parent’s email address and the child’s email address to notify the parent of the child’s wish to participate. The Parent must actively opt-in to their child receiving the newsletter by entering the code provided in the Parent email. If the Parent fails to opt-in, the code will be regenerated on every attempt to verify the parent’s email.

Information Collected Through the Use of the Website

Moose collects information on Website visitors, including information on which sections of the Website are most frequently visited, how often and for how long. This is done through Tracking Technologies, including cookies. This data is used as aggregated, non-personal information. Cookies do not contain any personal information about a specific user. Moose uses Usage information to improve and enhance our online service. You may disable cookies using your browser’s preferences, but some features of the Website may not function if you do so. We do not share this information externally. For more information about our technology practices, please review our general Privacy Policy.

 

III. How May Parents Access Children’s Personal Information?

Parents may review the personal information we have collected about their Child, request deletion, or refuse to allow further collection or use of that information. When processing a Parent’s request, we may require that you provide us with additional information to verify your identity as the Parent. When we delete personal information, it will be deleted from our active databases and permanently deleted from our systems after any legally required period for keeping such information has ended. 

 

IV. How we Use Children’s Information

We may use a Child’s personal information or Usage Data:

  • To enable a Child to participate in a variety of Services, including to track collectables or enter competitions, sweepstakes or contests;

  • To process a Child’s registration on the Website;

  • To improve the Services or to serve the Child specific content that is most relevant to the Child;

  • To contact the Child and Parent with regard to the Child’s use of the Services and, in our discretion, changes to the Services and/or Services’ policies; or

  • For purposes disclosed at the time the Child provides their information or as otherwise set out in this Privacy Policy.

 

V. How Does Moose Share Children’s Information?

Moose discloses personal information in the following circumstances:

  • In the event we are required to respond to subpoenas or other legal process or if in our good faith opinion such disclosure is required by law;

  • At the request of governmental authorities conducting an investigation;

  • To protect and/or defend the Services and the rights of our users or others; or
